GENERAL TERMS OF SALE AND RETURNS POLICY — chollobar.com
1) Identification

These General Conditions apply to all sales made through www.chollobar.com and govern the legal relationship between Group Invexlaters S.L. ("Chollobar") and the CUSTOMER. Chollobar sells both to private consumers and to businesses and professionals. In sales to private consumers, Spanish consumer protection legislation applies (Royal Legislative Decree 1/2007), including the right of withdrawal; in sales to businesses or professionals, the Commercial Code and the provisions of these conditions apply.
2) Order cancellation
To cancel, contact us through the website before the order leaves our warehouses. Once dispatched, cancellation is not possible, but you may exercise the right of withdrawal or request a return in accordance with the following conditions.
3) Right of withdrawal (private consumers)
If you are a private consumer, you have 14 calendar days from receipt of the order to withdraw from the purchase without needing to justify your decision, in accordance with Royal Legislative Decree 1/2007. To exercise it, simply communicate your decision to Chollobar within that period by email or WhatsApp, indicating the order number and the product.
No prior authorisation or the manufacturer's acceptance is required to exercise withdrawal. You may examine the product just as you would in a physical shop; you will only be responsible for the diminished value resulting from handling beyond what is necessary to check its nature, characteristics and functioning.
The cases provided for in the law are excluded from the right of withdrawal, such as products made to the consumer's specifications or clearly personalised.
4) Returns by businesses and professionals
Purchases made by businesses or professionals are governed by the Commercial Code. In these sales, except for a defect or error attributable to Chollobar, the return will require prior written authorisation from Group Invexlaters S.L. and, where applicable, the manufacturer's acceptance, and may entail the following deductions from the amount to be refunded:
- Outward and return transport costs.
- Handling costs.
- For returns, cancellations or exchanges not attributable to Chollobar, a charge for use and wear.
- The depreciation of the product when it shows damage.
5) Requirements and condition of the product
To process a return, the product must retain all its accessories, manuals and supplied items and, wherever possible, be returned in its original packaging or in other packaging that guarantees adequate protection during transport. In the case of private consumers, having opened or tried the product to check its functioning does not prevent the exercise of the right of withdrawal.
6) Costs and refund
When a private consumer exercises the right of withdrawal without there being a defect in the product, they will only bear the direct return costs (the return shipping). If the return is due to a shipping error, a defective product, damage during transport or any cause attributable to Chollobar, Chollobar will bear the corresponding costs.
The refund to private consumers will be made by the same payment method used in the purchase, without undue delay and, in any case, within 14 calendar days from when Chollobar becomes aware of the withdrawal, and may be withheld until the product or proof of its return has been received. In sales to businesses or professionals, the refund will be processed once the product has been received and checked.
7) Product exchanges
To request an exchange, contact us within 14 calendar days of receipt. Carriage-forward shipments are not accepted.
8) Transport incidents
On receiving your order, check that the packaging is in perfect condition. If you detect any damage, note it on the carrier's delivery note ("PACKAGING DAMAGED") and let us know as soon as possible so we can process the claim with the transport insurance.
9) Warranty
All products come with the applicable warranty according to the type of buyer. In sales to private consumers, the legal warranty for lack of conformity provided for in Royal Legislative Decree 1/2007 applies. In sales to businesses or professionals, the warranty is governed by the Commercial Code.
The warranty does not cover damage resulting from knocks, falls, misuse, incorrect installation, lack of maintenance, normal wear, external agents or intervention by an unauthorised technical service.
10) Applicable law
These conditions are governed by Spanish law. When the buyer is a consumer, the courts determined by consumer protection regulations will have jurisdiction; in relations between businesses or professionals, the parties submit to the courts of the registered office of Group Invexlaters S.L.
