It's a very common question. You want to protect your home, put a camera at the entrance or on the door, and suddenly you wonder: do I need to ask anyone's permission? Can the residents' association forbid it? Am I getting into legal trouble?

If you live in a flat or apartment
You can install it without permission if... The camera points exclusively towards the inside of your home or towards your front door, without capturing the landing, the communal hallway or the neighbours. In that case it's your private space and you don't need anyone's authorisation.
You need the association's permission if... The camera captures communal areas — the landing, the lift, the staircase or the building entrance. Those areas belong to all the owners and require approval at a residents' meeting.
If you live in a detached house or villa
You have more freedom. You can install cameras on your plot, garden, garage and entrances with no permission needed, as long as the cameras don't capture the public thoroughfare or the neighbours' property. Only your space, nothing more.
The most common mistake: A camera on the front door that captures a bit of the pavement or the street. Even if it's a small strip, it's already a breach of the Data Protection Act and can lead to a penalty from the AEPD.

Whether it's a flat or a house, the rule is always the same: the camera can only record what's yours. Your door, your garden, your garage, your terrace. The moment it captures other people's spaces — whether the neighbours', the association's or the public thoroughfare — there's already a legal problem.
